Terms of Service

By accessing or using Testimonix ("the Service"), operated at testimonix.io, you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service.

We may modify these terms at any time. Continued use after changes constitutes acceptance. Material changes will be communicated via email or an in-app notice.

• You must be at least 16 years old to use the Service.
• You must provide a valid email address and accurate information when creating an account.
• You are responsible for maintaining the security of your account and password.
• You are responsible for all activity that occurs under your account.
• One person or legal entity may maintain no more than one free account.
• You must notify us immediately at hello@testimonix.io if you become aware of any unauthorized use of your account.

You agree not to use the Service to:

• Violate any applicable law or regulation
• Collect or publish testimonials that are fabricated, misleading, or defamatory
• Impersonate any person or entity
• Upload content that infringes on intellectual property rights of others
• Distribute malware, spam, or harmful code
• Attempt to gain unauthorized access to other users' accounts or our infrastructure
• Scrape, crawl, or use automated means to access the Service beyond our public API
• Interfere with or disrupt the integrity or performance of the Service

We reserve the right to suspend or terminate accounts that violate these terms, with or without notice.

Your content is yours. You retain all rights to the testimonials you collect through Testimonix. We do not claim ownership of your content.

By using the Service, you grant us a limited license to store, process, display, and transmit your content solely for the purpose of providing the Service (e.g., rendering your testimonial widgets on third-party websites).

You are responsible for obtaining proper consent from individuals whose testimonials you collect. You must have a lawful basis for collecting, storing, and displaying their personal data, including names, photos, and video recordings.

Testimonial respondents may request removal of their testimonial. If a respondent contacts us directly, we will forward the request to you and expect you to comply within a reasonable timeframe.

The Service, including its original content (excluding user-generated content), features, functionality, design, and branding, is and will remain the exclusive property of Testimonix and its licensors.

The Testimonix name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Testimonix. You may not use them without our prior written permission.

We may provide an API for programmatic access to the Service. Use of the API is subject to these terms and any additional API-specific documentation.

• You must authenticate API requests with valid credentials.
• You must not exceed published rate limits. Abuse may result in throttling or suspension.
• API access may differ between plans. Free plans may have more restrictive limits.
• We may modify or discontinue API endpoints with reasonable notice.

Free accounts are available with feature limitations as described on our pricing page. Paid plans are billed in advance on a monthly or annual basis.

• All fees are exclusive of taxes unless stated otherwise.
• You can upgrade, downgrade, or cancel your plan at any time from your dashboard.
• Downgrading may cause loss of access to features or data that exceed the limits of your new plan.
• Refunds are available within 14 days of initial purchase if the Service does not meet your expectations. After 14 days, no refunds are issued for partial billing periods.
• We reserve the right to change pricing with 30 days' notice to existing customers.

Payments are processed by Stripe. By providing payment information, you agree to Stripe's Terms of Service.

You may terminate your account at any time by contacting us or using the account deletion feature in your dashboard. Upon termination:

• Your data will be deleted within 30 days, subject to legal retention requirements.
• Embedded widgets will stop rendering testimonials.
• Any outstanding invoices will remain due.

We may terminate or suspend your access immediately, without prior notice, for conduct that we believe violates these terms, is harmful to other users, or is harmful to us or third parties, or for any other reason at our sole discretion.

To the maximum extent permitted by applicable law, in no event shall Testimonix, its directors, employees, partners, agents, suppliers, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to, use of, or inability to use the Service
• Any conduct or content of any third party on the Service
• Unauthorized access, use, or alteration of your content
• Any interruption or cessation of the Service

Our total liability for any claims related to the Service shall not exceed the amount you have paid us in the 12 months prior to the claim.

The Service is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

These Terms shall be governed by and construed in accordance with the laws of Spain, without regard to its conflict of law provisions. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts located in Spain.

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
